Terms and conditions of data use

The British Election Study (“BES”) encourages the public to access and use the data that it collects and publishes on its web site www.britishelectionstudy.com. The data are organized in datasets and made available in machine-readable format (“Datasets”). Use of the data derived from the Datasets, which may appear in formats such as tables and charts, is also subject to these Terms and Conditions. Datasets may include data describing the Dataset called “Metadata”. If any datasets are credited to a source other than the BES, then those materials are not covered by these Terms and Conditions, and permission should be sought from the source provided. You are responsible for determining if this is the case, and if so, you are responsible for obtaining any necessary permission from the sources indicated.

 

By using the Datasets or any presentations of data derived from them, you agree to be bound by and adhere to these Terms and Conditions, as may be amended from time to time by the BES at its sole discretion.

  1. Licensed Use. Subject to these Terms and Conditions, the BES grants to you the royalty-free, worldwide, non-exclusive right to use, reproduce, extract, download, copy, distribute, display or include the Datasets and data contained therein in other products for research purposes.
  2. Retained Rights. Copyright in the Datasets remains vested in the BES, and the BES retains all rights not specifically granted hereunder.
  3. Acknowledgement and Disclaimer. By using the Datasets, you agree to appropriately acknowledge and provide attribution to the BES and to use the correct methods of citation in publications as given with each dataset.
  4. Altering or Modifying the Datasets. As part of the Licensed Use, you may alter or adapt the Datasets. 
  5. Personal Data. Do not divulge to third parties any Personal Data, Personal Information, confidential data or proprietary information which they encounter during their use of BES data. Do not share or give access to the data to any third party who has not agreed to these conditions. Protect personal data from the BES in accordance with the provisions and principles of General Data Protection Regulations and the Data Protection Act 1998 and its amendments. Any incidents of unauthorised access to, processing of or disclosing of the personal data must be reported immediately to the BES team ([email protected]).
  6. Prohibited Uses. No attempt to identify any individual (living or dead) using information contained with those data (including in British Election Study data obtained previously or in British Election Study data obtained from other sources) shall be made. You will not sell or otherwise transfer the Datasets and/or data contained therein to any third party, except within the Licensed Use. Furthermore, you shall not use the Datasets in a manner that falsifies or misrepresents their content.
  7. No BES endorsement. You shall not state or imply that the BES and the relevant funding agency or agencies endorse the manner or purpose of your use or reproduction of the Datasets, or that the BES endorses any entity, organization, company, product or services.
  8. No use of the BES emblem. Without the prior written approval of the BES, you will not use the logo of the British Election Study, nor present your work as endorsed by the BES.
  9. No Warranties by the BES. All reasonable precautions have been taken by the BES to verify the accuracy of the Datasets. Notwithstanding the foregoing, the Datasets are being provided to you without warranty of any kind, either expressed or implied. You will be solely responsible for your use of the Datasets. In no event shall the BES be liable for any damages arising from such use.
  10. Third-party materials. If you wish to reuse material from the Datasets that is attributed to a third party, such as tables, figures or images, it is your responsibility to obtain permission from the copyright holder for such reuse. The risk of claims resulting from infringement of any third-party-owned component in the Datasets rests solely with the user.
  11. Modification/discontinuation of Datasets. The BES reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Datasets, any means of accessing or utilizing the Datasets with or without prior notice to you.
  12. Your Indemnification of the BES. You agree to indemnify the BES for, and hold the BES harmless against, any claims and liabilities, including reasonable attorney’ fees and costs, arising from your use of the Datasets and/or breach of these Terms and Conditions.
  13. Termination. The BES shall have the right to terminate this Agreement, and the licence and rights granted hereunder, at any time by written notice to you, without incurring any liability whatsoever to you or others. Furthermore, the licence and the rights granted under this Agreement shall terminate automatically upon any breach by you of the terms of this Agreement. Upon receipt of a written request from the BES to that effect, you will promptly cease all use of, and destroy any and all copies of, the Datasets provided by the BES, and will confirm to the BES in writing that you have complied with the foregoing, no later than seven (7) days after receipt of the BES’s notification.
  14. Entire Agreement. These Terms and Conditions constitute the entire agreement between you and the BES with respect to its subject matter. The BES is not bound by any additional terms that may appear in any communication from you. Any amendment of these Terms and Conditions shall be subject to the BES’s written agreement, it being agreed that the BES may amend these Terms and Conditions from time to time at its sole discretion.
